Minnesota Offers A Powerful Remedy For Victims Of Domestic Violence

Criminal sanctions are often too late and concerned more with the prosecution of the abuser and not the protection and well-being of the victim. Minnesota’s response is the Domestic Abuse Act.

Its purpose is to provide appropriate civil remedies to protect victims from abusers. Its main protection is through the issuance of an Order for Protection (OFP), which is available when a family or household member commits an act of domestic abuse against another family or household member.

Domestic abuse is defined as:

  • Physical harm, bodily injury or assault
  • The infliction of fear of imminent physical harm, bodily injury or assault
  • Terroristic threats
  • Criminal sexual conduct
  • Interference with an emergency call

Family or household members include:

  • Spouses or former spouses
  • Parents and children
  • Persons related by blood
  • Persons who are presently residing together or who have resided together in the past
  • Persons who have a child in common
  • A pregnant woman and a man alleged to be the father
  • Persons involved in a significant sexual or romantic relationship
