Minnesota Offers A Powerful Remedy For Victims Of Domestic Violence

Criminal sanctions are often too late and concerned more with the prosecution of the abuser and not the protection and well-being of the victim. Minnesota’s response is the Domestic Abuse Act.

Its purpose is to provide appropriate civil remedies to protect victims from abusers. Its main protection is through the issuance of an Order for Protection (OFP), which is available when a family or household member commits an act of domestic abuse against another family or household member.

Domestic abuse is defined as:

  • Physical harm, bodily injury or assault
  • The infliction of fear of imminent physical harm, bodily injury or assault
  • Terroristic threats
  • Criminal sexual conduct
  • Interference with an emergency call

Family or household members include:

  • Spouses or former spouses
  • Parents and children
  • Persons related by blood
  • Persons who are presently residing together or who have resided together in the past
  • Persons who have a child in common
  • A pregnant woman and a man alleged to be the father
  • Persons involved in a significant sexual or romantic relationship

Protecting The Innocent From False Allegations Of Abuse

While it’s meant to protect abuse victims, the law is itself sometimes abused as a weapon against innocent parents, particularly fathers. Before a court has all the facts, a completely faultless dad can find himself excluded from the family home, without custody or visitation rights while still being responsible for financial support obligations.

This is unjust and disrespectful to fathers as well as the real victims of abuse. Our family law firm makes sure to fight fabricated allegations and prevent our clients’ lives from suffering damage because of false allegations.

Protect Your Children. Protect Yourself. Protect Your Rights.

We understand that domestic violence is an extremely difficult issue, and we will do everything possible to get you through it. Contact our St. Paul office today for a free consultation.
